PROFESSIONAL LIABILITY/PROPERTY AND
CASUALTY CLAIMS LITIGATION
Construction Claims Litigation
The firm's client base has always included a number of contractors
representing a variety of trades. The firm offers a multi-dimensional
construction/contractor practice in a claims environment including risk
management, the defense of property and casualty litigation, mechanics lien
claims, bonding claims, etc. We recognize that catastrophic losses and
construction sites in financial distress represent only a small segment
of the day-to-day needs of our construction industry clients. We pride
ourselves on our proven ability to successfully counsel clients through and
around the day-to-day headaches which are characteristic of this challenging
industry.
Employment Practices/Discrimination Litigation
Riding the crest of recent federal anti-discrimination and accommodation
laws, and the heightened sensitivity of our society to workplace torts
(harassment, discrimination, wrongful discharge, invasion of privacy),
litigation in the field of employment law has never been more prominent
and shows no signs of shrinking from the landscape. Our firm's litigation
group has counseled clients and tried cases on both sides of the issues.
Recently, we have been responding to a number of requests for risk management
in this area, from presenting seminars to middle managers about avoiding
sexual harassment and dealing with its aftermath, to editing or creating
textual materials for distribution via employee manuals, bulletins, or seminar
materials. This is an explosive area of the law with extremely high liability
stakes and an obvious potential to disrupt lives and organizations.
Recognizing this, our lawyers are inclined to be proactive in handling
employment law claims (or, more generally, the pre-claim environment)
whenever possible.
General Negligence
General negligence is a catch phrase for the broad spectrum of claims
encompassing most property and casualty losses. Examples include premises
liability; negligence claims involving landlords and condominium associations;
vehicular accidents involving automobiles, tractor trailers and buses;
construction site accidents; claims arising out of general and commercial
aviation; pleasure boat accidents; assault and battery; false imprisonment;
etc.
For a firm of this size, the breadth of our client base, and consequently,
our trial experience, is virtually unparalleled in this region. We are proud to
be included in Best's Directory of Recommended Insurance Counsel.
Products Liability
The representation of businesses accused of manufacturing, designing and/or
selling defective products capable of causing harm has always been at the core
of our practice. Our trial lawyers have considerable experience meeting the needs
of a wide variety of clients in these matters, ranging from manufacturers of
aerospace and ground transportation equipment to local vendors of consumer goods.
Our work in this area borrows from our insurance litigation practice an acute
sensitivity to issues of indemnification and coverage. We also approach product
claims broadly, offering our counsel on claim prevention opportunities as well
as on marketing plans, as they relate to product claim exposure.
Professional Negligence
In recent years, the professions have been particularly challenged by court
decisions and by regulations. As both practitioners and as business owners,
professionals need counsel and advocacy sensitive to their unique concerns
and risks.
The firm provides a range of services to physicians, accountants, attorneys, and design
professionals, which starts with an appreciation of their substantive fields,
and expands to their broader concerns as business owners and employers.
In the area of litigation services, our lawyers frequently represent professionals
in the courtroom, involving the defense of malpractice claims, contract disputes,
and fraud claims.
