TRUST AND ESTATE PLANNING AND ADMINISTRATION
An integral part of our practice is working with clients in developing
and implementing an estate plan which reflects the clients' intentions
for the transfer of accumulated wealth while keeping tax costs to a minimum.
This effort involves working closely with our clients, their accountants, or
financial advisors, to take maximum advantage of estate tax savings and
deferral opportunities. Typical of these activities are the drafting of
wills designed to take advantage of the Unified Credit against the Federal
gift and estate tax, irrevocable life insurance trusts, trusts for minors,
and charitable trusts and charitable remainder trusts (including those coupled
with wealth replacement life insurance trusts).
Our estate planning activities, under the direction of Warren Vogel, are
also designed to coordinate with our business and tax planning efforts.
A principal concern of virtually every closely held business is how to transfer
ownership interests in the business to the next generation. In turn, this
concern involves issues of family planning, particularly where less than all
of the next generation is involved in the business, and taxation, as the
determination of the value of a closely held business for tax purposes is
more of an art than a science.
In addressing these matters we have used a variety of techniques,
including family limited partnerships, buy-sell agreements, re-capitalizations
and discounting of minority and non-transferable interests to keep the cost
of wealth transfers to a minimum.
